Sealed bids for the construction of Jamesville Sewer District, Contract No. 1 will be received at the office of the Town Clerk, Town of DeWitt, 5400 Butternut Drive, East Syracuse, New York, 13057, until 11:00am, Local Time, June 18, 2009 and there at said office at said time publicly opened and read aloud.

The project includes the construction of approximately 9,720 linear feet of 8-inch diameter gravity sanitary sewer
mains, 60 linear feet of 6-inch diameter force main, a sewage pumping station,115 lateral connections, and 3,750 linear feet of 6-inch diameter lateral pipe and related appurtenances along NYS Route 173, North Street, South Street,School Street,Jutland Drive and Solvay Road in the Town of DeWitt, Onondaga County, New York.

Copies of the Contract Documents may be obtained at the Issuing Office of O’Brien & Gere Engineers, Inc.,
located at 5000 Brittonfield parkway, Syracuse, New York, 13221, for the nonrefundable sum of $100.00 for each set. Checks shall be payable to the Town of DeWitt.

The Owner is exempt from the payment of sales and compensating use taxes of the State of New York and of cities and counties on all materials, equipment and supplies sold to the Owner pursuant to this contract.

Also exempt from such taxes are purchases by the Contractor and his Subcontractors of materials, equipment and supplies to be sold tothe Owner pursuant to this Contract, including tangible personal property to be incorporated in any structure, building or other real property forming part of the Project. These taxes are not to be included in the Bid.

Each bid must be accompanied by cash, certified check, cashier’s check or bid bond in an amount not less than 5% of the amount of the bid.

Any contract or contracts awarded under this invitationfor bids are expected to be funded in part by a grant from
U.S. Environmental Protection Agency.

Neither the United States nor any of its departments, agencies or employees isor will be a party to this invitation for bids or any resulting contract. This procurement will be subject to regulations contained in 40 CFR PART 31.

A pre-bid meeting will be held at the DeWitt Town Hall, 5400 Butternut Drive, East Syracuse, New York, 13057 on
June 10, 2009 at 9am, local time.

All prospective bidders are urged to attend.

Bidders are required to take affirmative steps to assure that minority firms, women’s business enterprises and labor
surplus area firms are used when possible as specified in Sections 31-36(e)(2)(I through V) of the Federal Contract
Provisions.

The right is reserved to waive any informalities in the Bid and to reject any or all Bids.
